CHAPTER ONE
INTRODUCTION

The study was prompted by the escalating land conflict in Arapai Sub County despite the availability of clan institutions which are headed by clan leaders and known for conflict resolutions. This chapter contains general introduction, background of the study, problem statement, objectives of the study, research questions, definitions of key terms and concepts, scope the study, the significance of the study and justification of the study. 1.1 Background of the study 1.1.1 Historical perspective According to HAN (2010, page 10), land conflicts and the struggles to maintain or to gain access to and control over land is nothing new in the world. Wars on access to land have been felt in the Gaza strip (2014 Israeli-Gaza operation protective edge), have been felt in Russia-Ukraine, where according to Reuters and associated press (march 2014) the Russia- Ukraine war was struggle for Crimean Peninsula. In Asia land conflicts have been felt in Asia(Cambodia) where over 400000 people since 2003 have been affected by land acquisition for agribusiness according to john cherry (August 8,2013). Worldwide, land remains an important natural capital for every nation and individuals, and because of this, it’s not unusual that there is land conflict across the world, especially in developing nations where a huge population depends on agriculture for their livelihood (Wehrmann2008; Kairaba2000).
