CHAPTER ONE 1.0 Introduction In the last decayed, Alternative Dispute Resolution has taken significance in legal and judicial practice within the common law jurisdictions. Originally it started as a standalone mechanism largely operating outside the court system; however as time went on emerged court-based Alternative Dispute Resolution. Before delving into an attempt in defining ADR, it is pertinent to note that today, whenever we look across jurisdictions with widely different histories, entrenched cultures of dispute management are subject to re-examination and challenges. In common law countries, this turbulence in civil justice is at least unprecedented in recent times.
